1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "buyer/seller/consignor" as applicable) and Time Flies USA Inc., doing business as Time Flies Luxury Watches ("Time Flies," "we," "us," or "our"), governing your use of the website TimefliesLV.com (the "Site") and any transactions conducted with our business.

By accessing or using our Site, submitting any form, or engaging in a transaction with us, you agree to be bound by these Terms. If you do not agree, do not use the Site or engage in transactions with us.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use our Site or engage in transactions with us. By using our Site, you represent and warrant that you meet these requirements.

3. Products and Services

Time Flies buys, sells, sources, and consigns pre-owned luxury watches.

Inquiry-Based Model

Our Site operates on an inquiry-based model. Product listings on our Site are for informational and inquiry purposes only and do not constitute a binding offer to sell at any listed price. Submitting a request or inquiry through our Site does not constitute a binding purchase agreement. A binding agreement is formed only when both parties have confirmed the transaction details in writing (email, text, or other documented communication).

Product Accuracy

We make every effort to accurately describe the watches listed on our Site, including brand, model, reference number, condition, and documentation status. All watches are independently authenticated by our watchmaker prior to listing. Photographs are of the actual watch being offered unless otherwise noted. Minor variations in color may occur due to differences in screen displays.

Right to Refuse

We reserve the right to refuse or cancel any transaction at our discretion, including but not limited to situations where we suspect fraud, misrepresentation, or violations of these Terms.

4. Authentication and Authenticity Guarantee

Every watch sold by Time Flies is independently authenticated prior to sale. Our independent watchmaker physically opens and inspects every watch -- including the movement, dial, case, and serial numbers -- to verify authenticity and condition.

Unconditional Authenticity Guarantee

If any watch sold by Time Flies is proven to be inauthentic by a qualified independent authority, we will provide a full refund of the purchase price. This guarantee has no time limit and no conditions. The watch must be returned to Time Flies in the same condition in which it was delivered in order to receive the refund.

This guarantee applies to authenticity only. It does not cover disagreements about condition, value, or cosmetic preferences that were accurately described prior to sale.

5. Pricing and Payment

Pricing

All prices are quoted in United States Dollars (USD) unless otherwise specified. Prices are subject to confirmation by a member of our team. A quoted price is valid only when confirmed in writing (email or text) by Time Flies. We honor every confirmed price -- if market conditions change after we confirm a price, we absorb the difference.

Accepted Payment Methods

We accept payment via the following methods only:

  • Wire transfer (domestic and international)

  • Zelle (bank-to-bank transfer)

  • Cryptocurrency (Bitcoin and select cryptocurrencies -- contact us for current accepted currencies)

We do not accept credit cards, debit cards, PayPal, personal checks, money orders, Venmo, or cash app payments. We do not offer financing or installment payment plans.

Why These Methods

Wire transfer and Zelle are direct bank-to-bank transactions that are fully traceable and provide strong fraud protection for both buyer and seller. By avoiding credit card processing fees (typically 3-4%), we are able to offer more competitive pricing.

Payment Timing

Full payment is due upon agreement to purchase, prior to shipping. We do not ship watches before payment has been received and verified.

Taxes

You are responsible for any applicable sales tax, use tax, or other taxes associated with your purchase. Tax obligations vary by jurisdiction. Time Flies will collect sales tax where required by law.

6. Shipping and Delivery

Shipping Method

All watches are shipped via FedEx with full insurance coverage for the complete declared value of the watch. Watches are shipped to a FedEx secure hold location near the buyer's address. The buyer must present valid government-issued photo identification to pick up the package.

We do not ship to residential addresses or P.O. boxes. We do not offer doorstep delivery, signature waivers, or driver release options.

Shipping Costs

Shipping costs will be communicated to the buyer prior to finalizing the transaction. Specific shipping fees vary based on destination and declared value.

Shipping Timeline

Most orders ship within one to two (1-2) business days of payment verification. FedEx transit times vary by destination but are typically overnight within the continental United States. International shipping timelines vary.

Tracking and Communication

Tracking information is provided as soon as the shipment is created. We will keep you informed throughout the shipping process.

Risk of Loss

Risk of loss and title for purchased watches pass to the buyer upon delivery to the designated FedEx hold location and successful pickup with valid identification. Time Flies is not responsible for loss, theft, or damage that occurs after the buyer has taken possession of the package.

Insurance Claims

In the event of loss or damage during transit (before buyer pickup), Time Flies will manage the insurance claim process with FedEx. The buyer will receive a full refund or replacement once the claim is resolved.

International Shipping

International buyers are responsible for all customs duties, import taxes, and brokerage fees associated with their shipment. Time Flies is not responsible for delays caused by customs processing.

7. Return Policy

All sales are final. We do not accept returns, exchanges, or provide refunds except in the case of an authenticity issue as described in Section 4 (Authentication and Authenticity Guarantee).

Why We Do Not Accept Returns

We invest significant effort in pre-sale transparency to ensure you know exactly what you are purchasing before committing:

  • Every watch is independently authenticated by our watchmaker

  • Detailed, high-resolution photography of the actual watch is provided

  • Honest condition descriptions, including any imperfections, are included with every listing

  • Direct communication is available to answer every question before you commit

  • Additional photographs and documentation are provided upon request

This pre-sale process is designed to eliminate the need for returns. If you have any uncertainty about a watch, we encourage you to ask every question and request any additional information before proceeding with payment.

8. Warranty and Service Coverage

Manufacturer Warranty

Some watches sold by Time Flies may still be covered under the original manufacturer's warranty. Warranty status and documentation will be disclosed prior to sale. Time Flies does not represent or guarantee manufacturer warranty coverage unless explicitly stated.

Time Flies Service Coverage

For watches sold by Time Flies that are outside the manufacturer's warranty period, we provide mechanical service coverage as follows:

  • Coverage applies to mechanical defects and mechanical failures

  • Maximum coverage amount: $800 per service event

  • Coverage does not apply to: damage caused by misuse, neglect, unauthorized modifications, water damage (unless the watch is rated for the specific water exposure), impact damage, or normal cosmetic wear

This service coverage is provided as a commitment to standing behind what we sell. It is not a warranty in the legal sense and is subject to our evaluation of the issue.

9. Selling Your Watch to Time Flies

Valuation Process

When you submit your watch for valuation through our Site or direct communication, we will provide a no-obligation offer based on current market comparable sales data. Valuations are free of charge.

Offer Validity

Offers are valid for forty-eight (48) hours from the time of delivery, as market conditions can change. We will communicate the specific validity period with each offer. We honor every offer within its stated validity period -- if market conditions change during the validity period, we absorb the difference.

Payment to Sellers

Upon acceptance of our offer and receipt and verification of your watch, payment is wired to your designated bank account within forty-eight (48) hours.

Inspection Upon Receipt

All watches received for purchase are subject to inspection and verification upon arrival. If the watch does not match the description, condition, or photographs provided by the seller, we reserve the right to adjust our offer or decline the purchase. In the event of a declined purchase, the watch will be returned to the seller at our expense.

10. Trade-In Transactions

When you trade in a watch toward the purchase of another piece, we apply the agreed-upon trade-in value as credit toward your new purchase.

  • Trade-in values are based on the same market research methodology used for outright purchase offers

  • Trade-in credit can be applied toward any watch in our current inventory or toward a sourced piece

  • If the trade-in value exceeds the price of the new watch, the difference will be paid to you. If the price of the new watch exceeds the trade-in value, you are responsible for the balance

  • Trade-in transactions are processed as a single transaction for your convenience

11. Consignment

Time Flies offers consignment services under the following terms:

Listing Price

The consignment listing price is determined through mutual agreement between the consignor and Time Flies, based on recent comparable sales and current market conditions.

Commission

Time Flies charges a commission of twelve percent (12%) of the final sale price. This commission is the only fee charged to the consignor.

Fees Covered by Time Flies

Time Flies covers all costs associated with the consignment sale, including but not limited to:

  • Shipping costs (both receiving the watch from the consignor and shipping to the buyer)

  • Payment processing fees

  • Marketing and listing costs

  • Photography costs

  • Authentication costs

The consignor is not responsible for any fees beyond the 12% commission.

Payment to Consignor

Upon successful sale of the consigned watch, the net proceeds (sale price minus 12% commission) are wired to the consignor's designated bank account within forty-eight (48) hours of the sale closing.

Minimum Listing Period

Consigned watches must remain listed for a minimum of thirty (30) days from the date the watch is received by Time Flies.

Early Return

If the consignor requests return of the watch before the 30-day minimum listing period has elapsed, a return fee of $250 applies. This fee covers shipping and handling costs. After the 30-day minimum period, the consignor may request return of the watch at no cost.

Care and Insurance

While in our possession, consigned watches are stored securely and insured for their agreed-upon value. Time Flies exercises reasonable care in handling all consigned pieces.

Price Adjustments

Any price adjustments to the consignment listing require mutual agreement between the consignor and Time Flies. We will not reduce the listing price without your approval.

Consignment Agreement

A separate written consignment agreement detailing the specific terms for your watch will be provided before any consignment arrangement begins. The terms in this section provide a general overview and are subject to the specific terms of the individual consignment agreement.

12. Watch Sourcing Services

Time Flies offers watch sourcing services to locate specific watches through our dealer network.

No Obligation

Sourcing requests are submitted at no cost and with no obligation. You are not required to purchase any watch located through the sourcing process.

Timeline and Communication

We will provide an honest timeline estimate for your sourcing request and keep you updated throughout the search process. If a watch cannot be located within a reasonable timeframe, we will inform you promptly and discuss alternatives.

Authentication

All sourced watches undergo the same independent authentication process as watches from our own inventory before being presented to you.

13. Intellectual Property

All content on our Site -- including text, photographs, graphics, logos, icons, and the overall design and layout -- is the property of Time Flies USA Inc. or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, display, perform, or otherwise use any content from our Site without our prior written consent, except for personal, non-commercial use such as saving product images for your own reference.

The Time Flies name, logo, and any related trademarks, service marks, or trade dress are the property of Time Flies USA Inc. and may not be used without our prior written permission.

14. User Conduct

When using our Site or communicating with us, you agree not to:

  • Provide false, misleading, or fraudulent information in any form, communication, or transaction

  • Attempt to purchase watches using stolen financial information or engage in any form of payment fraud

  • Misrepresent the condition, authenticity, or provenance of any watch submitted for sale, trade-in, or consignment

  • Use our Site or services to engage in money laundering or any other illegal activity

  • Interfere with or disrupt the operation of our Site

  • Attempt to gain unauthorized access to any part of our Site, systems, or data

  • Scrape, copy, or harvest content from our Site without permission

  • Use our Site in any manner that violates applicable local, state, national, or international law

15. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Time Flies' total liability for any claim arising from or related to a transaction shall not exceed the purchase price of the specific watch involved in the claim.

  • Time Flies is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, or business interruption, arising from or related to your use of our Site or any transaction with us.

  • Time Flies is not liable for any delays, failures, or interruptions in the operation of our Site caused by circumstances beyond our reasonable control, including but not limited to internet outages, server failures, natural disasters, or acts of government.

16. Indemnification

You agree to indemnify, defend, and hold harmless Time Flies USA Inc., its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of our Site or services

  • Any transaction you engage in with us

  • Your violation of these Terms

  • Your violation of any applicable law or the rights of any third party

  • Any misrepresentation made by you regarding the condition, authenticity, or ownership of any watch submitted for sale, trade-in, or consignment

17. Dispute Resolution

Governing Law

These Terms and any disputes arising from them or from any transaction with Time Flies shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal legal action, you agree to first contact us at [BUSINESS EMAIL] to attempt to resolve the dispute informally. We will make a good-faith effort to resolve any dispute within thirty (30) days of receipt of your written notice.

Jurisdiction

If informal resolution is unsuccessful, any legal action or proceeding arising from or related to these Terms or any transaction with Time Flies shall be brought exclusively in the state or federal courts located in Clark County, Nevada. You consent to the personal jurisdiction of such courts and waive any objection to venue.

18. Disclaimer of Warranties

Our Site and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Time Flies disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information on our Site.

This disclaimer does not apply to our Authenticity Guarantee (Section 4) or Service Coverage (Section 8), which are governed by their respective terms above.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Time Flies regarding the use of our Site and any transactions conducted with us. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter hereof.

For consignment transactions, the individual Consignment Agreement supplements these Terms and governs in the event of any conflict specific to the consignment arrangement.

21. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Material changes will be communicated via a prominent notice on our Site.

Your continued use of our Site or engagement in transactions with us after the posting of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must discontinue use of the Site.
